Establishment of Social Security Scheme “Health Care Scheme”

For Persons Defined by the Provisions of the Labor law The Royal Government

 

• Having seen the Constitution of the Kingdom of Cambodia;
• Having seen Royal Kret No. NS/RKT/0913/903, dated September 24, 2013 on the Appointment of the Royal Government of Cambodia;
• Having seen Royal Kret No. NS/RKT/1213/1393, dated December 21, 2013 on the amendment and additional composition of the Royal Government of Cambodia;
• Having seen Royal Kram No. 02/NS/94, dated July 20, 1994 promulgating the Law on the Organization and Functioning of the Council of Ministers;
• Having seen Royal Kram No. NS/RKM/0105/003, dated January 17, 2005 promulgating the Law on the Establishment of the Ministry of Labor and Vocational Training;
• Having seen Royal Kram No. NS/RKM/0196/18, dated January 24, 1996 promulgating the Law on the Establishment of the Ministry of Economy and Finance;
• Having seen Royal Kram No. CS/RKM/0397/01, dated March 13, 1997 promulgating the Labor Law;
• Having seen Royal Kram No. NS/RKM/0902/018, dated September 25, 2002 promulgating the Law on Social Security Scheme for Persons Defined by the Provisions of the Labor Law;
• Having seen Royal Kret No. NS/RKT/0815/872, dated July 08, 2015 on the legal statute of the public administrative entity;
• Having seen Sub-decree No. 283 RNKr.BK, dated November 14, 2014 on the Organization and Functioning of the Ministry of Labor and Vocational Training;
• Having seen Sub-decree No. 488 RNKr. BK, dated October 16, 2013 on the Organization and Functioning of the Ministry of Economy and Finance;
• Having seen Sub-decree No. 16 RNKr.BK, dated March 2, 2007 on the Establishment of National Social Security Fund;
• Pursuant to the request from Minister of Labor and Vocational Training and Minister of Economy and Finance.

 

DECIDED

Chapter 1

General Provisions

Article 1._

This Sub-decree aims at establishing the social security scheme “Health Care Scheme” as in the Law on Social Security Scheme for Persons Defined by the Provisions of the Labor Law.

 

Article 2._

 This Sub-decree aims at establishing the mechanism to provide NSSF members the preventive health service and benefit of treatment and medical care, and provide daily allowance during the work suspension resulting from disease treatment or other accidents other than occupational risk and maternity leave.

 

Article 3._

 This Sub-decree applies to persons defined by the provisions of the Labor Law including spouse and dependent children of workers who are member of NSSF, and NSSF members who are receiving pension resulting from the permanent disability and survivors.

 

Article 4._

        The terminologies used in this Sub-decree shall be defined as the followings:

• Health Care: refers to the social health insurance, in which benefit of preventive health service and benefit of treatment and medical care, and daily allowance during the work suspension resulting from disease treatment or other accidents other than occupational risk and maternity leave, shall be provided.
• Benefit: refers to the providing of preventive health service and treatment and medical care service, and daily allowance during the work suspension resulting from disease treatment or other accidents other than occupational risk and maternity leave.
• Spouse: a wife or husband with authorized marriage certificate.
• Survivor: a person who survives including a wife or husband and dependent children of NSSF member after the death due to occupation risk. 

 

Chapter 2

Authority in Charge

Article 5._

The National Social Security Fund (NSSF) is the only executive institution in charge of organizing and managing social security scheme “Health Care Scheme” for persons defined by the provisions of the labor law.

 

Article 6._

A senior council who is a legislator of the social security scheme shall be established by a separate Sub-degree to inspect, monitor, and observe the managements and to administer the social security scheme “Health Care Scheme” of NSSF, and to set development policies of social security system. 

Chapter 3

Contributions, Benefits, and Finances 

Reserved for Health Care Scheme

Part 1

Contributions for Health Care Scheme

 

Article 7._ 

Employers and workers under the provision of the law on social security scheme for persons defined by the provisions of the labor law, are obliged to pay the contribution for health care scheme to NSSF. The amount of the contribution paid by workers shall not exceed than that paid by employers.

Rate of contribution for health care scheme, form and procedure of this contribution payment shall be set by Prakas from The Minister of Labour and Vocational Training with the agreement of The Minister of Economy and Finance upon the request from the Governing Body of NSSF.

 

Part 2

Benefits of Health Care Scheme

 

Article 8._

Benefits of health care scheme set in this Sub-decree include preventive health service, treatment and medical care service, and daily allowance during the work suspension resulting from disease treatment or other accidents other than occupational risk and maternity leave.

Types of services and illness which have not been included in the benefits of health care scheme shall be set by Prakas from the Minister of Labour and Vocational Training upon the request from the Governing Body of NSSF.

Form and Procedure of benefits provision of health care scheme shall be set by Prakas from the Minister of Labour and Vocational Training upon the request from the Governing Body of NSSF.

The Mechanism of payment for preventive health service, treatment and medical care service shall be set by a joint Prakas between the Minister of Labour and Vocational Training, and the Minister of Health upon the request from the Governing Body of NSSF.

 

Article 9._

Receiving of the benefits of health care scheme shall be pursuant to conditions related to the insurance length and referral length, all of which are set by Prakas from the Minister of Labour and Vocational Training upon the request from the Governing Body of NSSF.

 

Part 3

Finances Reserved for Health Care Scheme

 

Article 10._

The minimum finances reserved for health care scheme shall be equal to the amount of

expense for benefits during the last 01 (one) year. 

 

Chapter 4

Recognition and Examination 

of Service Quality of the Local Health Center

Part 1

Recognition of Service Quality

 

 

Article 11._

Treatment and medical care shall be provided by the local health center recognized by the Ministry of Health which signed an agreement with NSSF. 

The recognition of the service quality of the treatments and medical care shall be in compliance with the principles set by the Ministry of Health.

 

Part 2

Examination of Service Quality

 

Article 12._

Service quality of the local health center shall be under the examination, monitor, and observation of the medical committee of NSSF. 

The composition, roles and obligations of the medical committee of NSSF shall be set by joint Prakas between the Minister of Labour and Vocational Training, and the Minister of Health upon the request from the Governing Body of NSSF.

 

Chapter 5

Phase of Implementation

 

Article 13._

 The first phase of health care service provision shall be implemented to only members of NSSF and survivors.

The provision of health care for spouse and dependent children shall be implemented in due cause pursuant to the social situation and actual economy set by Prakas from the Minister of Labour and Vocational Training upon the request from the Governing Body of NSSF.

 

Chapter 6

Final Provision

Article 14._

Minister in charge of Councils of Minister, Minister of Economy and Finance, Minister of

Labour and Vocational training, Minster of Health, Minister of Civil Service, Ministers of all Ministries and directors of related institutions, and Executive Director of National Social Security Fund, shall implement this Sub-decree as of the signature date.
